Compliance with Act 25
The Morgentaler Clinic complies with the Act to Modernize Legislative Provisions Regarding the Protection of Personal Information (commonly known as Bill 25), which came into full effect in Quebec on September 22, 2023. Your medical information is also protected under the Health and Social Services Act, the Code of Ethics for Physicians, and the duty of confidentiality.
1. Introduction
Morgentaler Clinic places great importance on protecting your personal information. This privacy policy explains how we collect, use, share, and protect your information in accordance with applicable privacy laws.
2. Collected information
We may collect the following types of personal information:
- For visitors to our website (first name, phone number, preferences, IP address, and session data)
- For our patients (identification and contact information, health data, and clinical information)
- For accompanying persons (identification and contact information)
- For job applicants (identification and contact information, application file)
- For employees (identification and contact data, HR data, financial information, emergency contact)
- For our service providers (administrative and financial data)
3. Purposes of information collection
We collect your information for the following reasons:
- Making appointments
- Providing and monitoring healthcare services
- Billing payers

4. Consent
In accordance with Act 25, your consent is required before any collection, use, or disclosure of your personal information, except in cases provided for by law. Consent must be free, informed, and given for specific purposes. When personal information must be used or disclosed for a purpose other than that set out in this policy, new consent must be obtained. For health services for minors:
- Minors aged 14 and over may consent themselves to the collection, use, and disclosure of their personal information related to the care they receive.
- For minors under the age of 14, the consent of a parent or legal guardian is required, except in situations provided for by law.
5. Sharing of information
Your personal information may be shared with third parties:
- With a clinic supplier, only when necessary to provide our services and for the purposes stated above. For example, some of your information is sent to Optilab laboratories to obtain results, and some information is sent to the RAMQ for billing purposes. We limit this information to the minimum required. Third parties must be approved by the clinic and offer equivalent protections. A formal commitment must be obtained before any personal information is shared.
- If required by law or a regulatory authority.
- At your request.
6. Protection measures
We implement safeguards to protect your information from unauthorized access, disclosure, alteration, or destruction. These measures include limiting access to authorized employees, signing confidentiality agreements, maintenance and security updates provided by our certified service center, multi-factor authentication, access control to premises, and secure document destruction, among others. When the clinic needs to use information for purposes that do not require the direct identification of the individuals concerned, the data is anonymized whenever possible and appropriate. If anonymization is not possible, access must be limited to the minimum necessary.
7. Retention of information
Your personal information will be retained only for as long as necessary to fulfill the purposes for which it was collected, unless a longer retention period is required by law. Its destruction is planned in accordance with Morgentaler Clinic's internal policy.
8. Your rights
In accordance with Act 25, you have the following rights:
- Access your personal information.
- Correct inaccurate or incomplete information.
- Withdraw your consent.
- Request the deletion of your information in certain situations.

In the event of an incident involving the confidentiality of your personal information that poses a risk of serious harm, we will notify you without delay in accordance with Section 3.5 of Act 25 and will notify the Quebec Commission for Access to Information.
